A FORCED miscarriage is a term used for a late term abortion, which is what can be prosecuted; in actual medical terminology though, this is not referred to as a miscarriage, which is what the danish fellow was trying to explain to your 2ft thick skull. An actual miscarriage is something you cannot control, so there is no way for you to be prosecuted for it as a crime under US law.

Innocent unless proven guilty by law. The prosecutor has the weight of proof. If the law does not clearly give them a legal case then there is nothing to even go to court over. It would be an easy win for the plaintiff if it ever went to court.

You can technically be prosecuted for a miscarriage under these laws. I can already foresee a case where a prospective mother is charged due to negligence (which wouldn't necessarily require a great deal of evidence from the prosecution to provide the necessary burden of proof). However, with the Roe v Wade decision, this is currently unenforceable. All this is intended to do is present another opportunity to raise the issue before the supreme court imo. It actually holds no weight.
