The distinction between a loophole and not a loophole, typically, is whether the law is being used as intended. In our case, we are offering wagering as it was intended. We know because we work with regulators and operators existing in the space.
To be clear, we don't offer esportsbook wagering in the US. The reason UMode is available while esports betting is not is because many lawmakers intentionally differentiate between betting on an act of skill (like playing CSGO), betting on others playing a game of skill (like esports) or games of pure chance (like slots). These categorizations exist intentionally and are being used as intended (we checked).
Most states use something called the Dominant Principle Test, which CSGO and many other online games pass because of the influence of skill, opportunity to showcase that skill, abundance of data and a few other factors. These tests are actively written into the law specifically for use on cases like this -- and if the law doesn't permit betting in this or a similar way, we don't operate.
We understand betting isn't for you, and we're glad you know what you want, but many people find betting to be a good way to enhance their enjoyment of hobbies like playing games or watching esports.
We're making sure there's a legal, regulated, safe place to do this, which takes legal betting customers out of the pockets of illegitimate sites or predatory betting sites. By taking those bettors who could legally bet off sites that target minors or at-risk bettors, we're reducing their volumes and making it harder for predatory & illegitimate operators to run.
We're really proud of the positive impact we have on esports and the way our work has helped contribute to cleaning up the esports betting space. Unikrn is an American company with our own licensing, a wide array of experiences to offer, each only available in regions where they're meeting regulatory standards.
