ESIC dont have a say, even if they did pay them some money like heroic and it's fine. Anyway, it's the TO so IEMs ruling but yeah u are right, unless both team's reach agreement as its only qualifiers...

I don't remember all cases but I think it has already happened or couldve happened before. In RMR NBK couldve played vs OG (didn't happen because of bracket) and in spring EPL niko couldve played vs Heroic (I think was not allowed by Heroic)

But NBK wouldn't be allowed to play if they played OG. It was stated in the (I don't remember if it was Valve or the TO) rules

Hm, interesting then Because I know that Young Ninjas were not allowed to play ESEA Advanced 38, because there was this slight chance of them qualifying to ESEA Premier and through it to ESL Pro League, so ESL should have some rules for preventing conflict of interests "Note: 23 Sep '21: Young Ninjas were replaced by OFFSET as the former are not eligible to compete in ESEA Premier (if they qualify) due to the conflict of interest with the main team (NIP) under the same competitive structure (ESL Pro League and ESEA Premier)"
