hi so i have a quick question regarding American contract laws. So lets say someone entered a contract to work for a company that does not necessarily do legal things ( under American law at least) Excluding the parties involved, the contract seems to be perfectly legal (neither party are required to participate in illegal actions) Is the contract still binding even though one of the parties is illegal ?????? pls answer quick its a matter of life and death !!!!!!!!!

So little data. If you are contracted to do legal stuff ofc Contract is binding. If employee forces you go do illegal activities you duty is to report it (also non reporting is a felony). Perhaps some of USA colleagues can explain better but it would help if you described this better

Ok so lets assume its a work contract. The company in this case is a foreign company (Polish of course) that is illegally operating in America. They give their American employees work contracts and lets say the work is to enter data into a pc (perfectly legal job) So in this case one of the parties (the worker) is fully legal and capable while the other party (the employeer) is illegal. Can the contract be enforced by the illegal party?

How you know the employee is doing something illegal? If they are registered in US and operating there its not your problem unless they give you illegal task. Data you are filling in is legal, so is the job. Its like doing proper work and the owner is the criminal. Until he is arrested and his assets are freezed there is 0 impact on you as long as you are not aware of fellonies. You can relax

Yea its a perfectly legal job for what is essentially a criminal. The worker is not involved in any on the operations of the employer save for entring data into a pc. But lets say the worker somehow (very honest mistake) breaches the employment contract. Can the employer (illega partyl) enforce the contract and force legal action onto the worker ?

Yes he can as long contract obligations was legal and was not fullfiled. If managing director is clean in US he can represent the firm in front of the Court or hire laywers. I cant imagine that someone with unclear record can run a firm. Check who is exactly your employee, can be different name/firm

ooh ok thank I see Thats the issue so first they said czech but then in their correspondance they said mentioned they are actually based in Poland Also application was for a certian company but another company handled the interveiw and the final contract was signed with a third company. I guess its also kinda sus they only pay in cash

Welk idk how its functioning in US but part should go through account. That might be daughter companies or not connected firms with same ownership. I can't answer you certainly without reasearch and more data but what I already have. You can't avoid Court process by the sole reason being that your employer is doing shady stuff in other country. Hope I helped
